In Florida, before filing for Chapter 7, debtors must pass a means test. This test shows the debtor’s income level and disposable income compared to Florida’s median household income. If your household income is less than Florida’s median income for a household of your size, you automatically pass, and can file for Chapter 7. But if household income exceeds Florida’s median income for a household of your size, then your disposable income is calculated. If your disposable income exceeds a certain amount, then you cannot file Chapter 7 and will have to file a Chapter 13 bankruptcy instead.
